(the “Company”), an imminent danger order (the “Order”) under Section 107(a) of the Federal Mine Safety and Health Act of 1977, as amended, at the Sivells Bend mine in Cooke County, Texas. The Order was issued after an MSHA inspector observed a MOR PPM worker welding approximately 25 feet above ground on a platform to install stairs that were being lifted by an extended-boom forklift.
