Insights

Patent suit introduces legal uncertainty but no quantified impact yet.

Vertical Aerospace has been sued by Archer Aviation for alleged design and utility patent infringement in a U.S. federal court. Vertical disputes the allegations and plans to defend vigorously, signaling it does not anticipate changing its current strategy based on the suit.

The filing does not describe potential damages, timelines, or specific patents at issue, so the financial and operational impact cannot be gauged from this disclosure alone. Vertical reiterates its focus on certification and commercialization of its Valo eVTOL and hybrid-electric aircraft, suggesting ongoing execution of its existing plans.

Future company filings and court developments will clarify whether the litigation affects certification progress, commercial agreements, or its intellectual property strategy. Until there is a judgment, settlement, or detailed claims description, investors only know that a legal dispute exists between two competitors in the advanced air mobility space.

Vertical Aerospace Addresses Archer Aviation Claims

London, UK & New York, USA – 24/02/2026 – Vertical Aerospace (“Vertical” or “Company”) [NYSE:EVTL], a global aerospace and technology company that is pioneering electric aviation, today provided the following statement in response to a patent infringement complaint filed by Archer Aviation in the U.S. District Court Eastern District of Texas:

Archer’s recent claims are without merit, and Vertical intends to defend those claims vigorously. Vertical has developed a robust aircraft design with a clear path to certification, underpinned by Vertical’s proprietary and market-leading technology and international IP portfolio. Archer’s claims are merely an attempt to distract from the challenges Archer is facing competing in the marketplace.

“Vertical’s aircraft architecture, proprietary technology stack and certification pathway have been independently developed over many years and are protected by a robust portfolio of intellectual property rights,” said Domhnal Slattery, Vertical Aerospace Chair. “Our focus remains firmly on execution and certification. That is where sustainable value is created - and that is where we are leading.”
