Rhea-AI Filing Summary

Sigma Lithium reports that a Court of Appeal judge in Minas Gerais has overturned a prior lower-court decision that had included the potential for a US$10 million legal collateral. The judge instead requested that the company fund an independent technical advisory firm to monitor operational impacts on nearby municipalities.

The ruling relied on 12 months of environmental monitoring data collected and verified by external experts, showing low levels of dust, vibrations, and noise in four neighboring communities. Sigma Lithium highlights that it operates 560% better than recommended standards for total suspended particles and 350% better for fine particles, with 95 noise measurement campaigns demonstrating compliance with Brazilian standards.

The company also reiterates its broader operating profile, including a nameplate capacity of 270,000 tonnes of lithium oxide concentrate per year (approximately 38,000–40,000 tonnes of LCE) at its Grota do Cirilo operation in Brazil and a Phase 2 expansion aiming to increase capacity to 520,000 tonnes.

Current concentrate capacity 270,000 tonnes/year Nameplate lithium oxide concentrate capacity at Grota do Cirilo
LCE output range 38,000–40,000 tonnes Approximate annual lithium carbonate equivalent from current capacity
Post-expansion capacity target 520,000 tonnes/year Planned capacity after Phase 2 expansion
independent technical advisory firm technical
"asked the Company to fund the engagement of an independent technical advisory firm to monitor the impacts"
environmental monitoring data technical
"publicly disclosed 12 months of environmental monitoring data, independently collected and verified by external experts"
nameplate capacity financial
"currently has a nameplate capacity to produce 270,000 tonnes of lithium oxide concentrate"
Nameplate capacity is the maximum output a power plant, factory, or piece of equipment can produce under ideal conditions, as specified by the manufacturer. Investors care because it sets the upper limit on potential revenue and growth—actual earnings depend on how often and efficiently that capacity is used, similar to a car’s top speed versus how fast you actually drive in daily traffic.
forward-looking information regulatory
"This news release includes certain “forward-looking information” under applicable Canadian and U.S. securities legislation"
Forward-looking information are predictions, plans, estimates or expectations about a company’s future performance, results or events, such as sales forecasts, project timelines, or anticipated costs. It matters to investors because these statements guide expectations but rely on assumptions and uncertain factors—like a weather forecast for a business—so investors should treat them as informed guesses rather than guarantees and consider the risks and possible changes behind the numbers.
Zero Tailings strategy technical
"achievements and projections relating to the Zero Tailings strategy, achievement of ramp-up volumes"

SIGMA LITHIUM WINS IN STATE COURT OF MINAS GERAIS; OVERTURN OF UNWARRANTED LOCAL JUDGE DECISION

HIGHLIGHTS

·         A Court of Appeal Judge in the Court of Justice of Minas Gerais state overturned a local lower court decision that included the potential for a legal collateral of US$10 million.

·         The ruling was based on robust quantitative evidence presented by Sigma Lithium: one year of environmental data collected by third parties demonstrating the Company’s track record – low levels of dust, vibrations, noise, measured by independent experts in four neighbouring communities – in addition to other legal issues.

·         The data-based defence presented by the Company debunked the baseless claims made by local prosecution and was accepted by the state court judge.

São Paulo, June 9, 2026 – Sigma Lithium Corporation (NASDAQ: SGML, TSX-V:SGML BVMF: S2GM34) (“Sigma Lithium” or the “Company”), the largest producer of lithium oxide concentrate in the Americas¹ and dedicated to industrializing socially and environmentally sustainable lithium materials to supply global producers of batteries for energy security, announces that a Court of Appeal Judge in the the Court of Justice of Minas Gerais state (“Court of Justice”) overturned a local lower court decision that included the potential for a legal collateral of US$10 million, as detailed in the Company’s announcement of May 18, 2026.

The Court of Justice asked the Company to fund the engagement of an independent technical advisory firm to monitor the impacts of Sigma Lithium operations on the residents of the local municipalities of Araçuaí and Itinga. The Company welcomed the requirement of the impact assessment study as an excellent opportunity to establish the facts of the matter through an independent evaluation.

Sigma Lithium’s legal counsel highlighted the discrepancy between the data presented by the prosecution and the evidence submitted by the Company in its defense. On June 2, Sigma Lithium publicly disclosed 12 months of environmental monitoring data, independently collected and verified by external experts through May 2026, demonstrating the Company’s environmental performance and track record: low levels of dust, vibrations, noise, monitored in four neighbouring communities.

·         Dust: Sigma Lithium operates 560% better than recommended standards for total suspended particles, 350% better for particles of below 2.5 micrometers.

·         Noise: 95 measurement campaigns conducted during night and day demonstrated compliance with Brazilian established standards.

·Vibrations: The level of vibrations measured in terms of velocity measured in millimeters per second against the frequency measured in Hertz was extremely low, barely registering on the seismograph scale, when set against the recommended limits.
