DuPont (NYSE:DD) has secured a significant legal victory as Dawnsens New-Materials Co. (Dangs) voluntarily agreed to a 10-year exclusion order approved by the International Trade Commission (ITC). The order prohibits Dangs from selling and importing materials related to DuPont's Tyvek® products into the United States, following allegations of trade secret misappropriation.

The case, initiated in October 2024, involved DuPont's claims of trade secret misappropriation and trademark infringement. The consent order is now being enforced by the ITC and U.S. Customs and Border Protection, with immediate effect. While litigation against Dangs has concluded, the ITC investigation continues for remaining respondents.

Customs and Border Protection ed è efficace immediatamente.

Insights

DuPont secures major IP victory as competitor Dawnsens accepts 10-year US import ban for Tyvek-like materials.

This consent order represents a significant legal victory for DuPont in its intellectual property enforcement strategy. Dawnsens' voluntary acceptance of a 10-year ban on selling and importing its flashspun nonwoven materials into the US market effectively validates DuPont's trade secret misappropriation claims without requiring a protracted legal battle. The involvement of the International Trade Commission (ITC) and US Customs and Border Protection provides powerful enforcement mechanisms through import restrictions that would be difficult to obtain through standard litigation channels.

The consent order's immediate effect creates a decade-long competitive shield for DuPont's Tyvek® business in the US market. The company's strategic approach—pursuing multiple entities simultaneously through the ITC—has already resulted in several voluntary consent orders, suggesting the strength of DuPont's evidence and legal position. This outcome allows DuPont to protect its market position without revealing additional proprietary information that might have been necessary in continued litigation.

DuPont's mention of "exploring all available enforcement options" in global markets signals this is likely part of a broader international IP protection strategy. Competitors should note that DuPont appears willing to aggressively defend its intellectual property across multiple jurisdictions, potentially using this ITC victory as leverage in other markets where Tyvek® faces similar competitive threats.

WILMINGTON, Del., Sept. 8, 2025 /PRNewswire/ -- DuPont (NYSE:DD) today announced that the International Trade Commission (ITC) approved Dawnsens New-Materials Co. ("Dangs") voluntary agreement to a consent order which excludes Dangs from selling and importing into the United States all accused materials and products containing such materials for a period of 10 years. This decision concludes DuPont's litigation against Dangs at the ITC for the misappropriation of trade secrets related to DuPont's Tyvek® products.

The ITC is an independent, non-partisan agency responsible for investigating and making determinations in cases involving imports that are claimed to harm domestic industries or violate U.S. intellectual property rights. In October 2024, DuPont requested that the ITC investigate its claims of trade secret misappropriation and trademark infringement relating to the Tyvek® brand and products and issue an exclusion order to prohibit the importation of any infringing materials into the United States.

"For many years, DuPont has been dedicated to delivering exceptional innovation through our technology and products. This commitment is why so many customers rely on the superior quality and performance of authentic Tyvek® products in their most crucial applications," stated David Domnisch, Vice President & General Manager of DuPont™ Tyvek®. "We are very pleased with the consent order agreed to by Dangs, and we remain fully committed to advocating for fair competition. We will vigorously protect our intellectual property rights from infringement and will explore all available enforcement options in the U.S. and other global markets."

The consent order, which is enforced by the ITC and United States Customs and Border Protection, is in place and effective immediately.

Litigation against Dangs and multiple other entities has now been terminated via voluntary consent orders. The ITC investigation remains ongoing for the final respondents.
